Discussion on FEMA – Recent developments and emerging issues

Dear Member,

The Foreign Exchange Management Act, 1999 (“FEMA”) is India’s key legislation governing inbound and outbound investments.  Rising investments make it essential for the professionals to understand the regulations that govern capital inflows and outflows and the related evolution.

In tune with the aspirations of a large young population, the Government has rolled out several big-bang initiatives in the form of Make in India, Skill India, Start-up India and the likes. Simultaneously, recognising the need to usher in foreign investments to reinvigorate the growth cycle, the Government has adopted a policy of extensive outreach, focused on the ease of doing business on one hand and the overhaul of FEMA regulations and FDI policies regulating the inflow of foreign investments into India on the other.  The thrust of the overall policy has been to bring more and more sectors under the automatic route and also relax the foreign ownership norms in sectors where foreign investment was hitherto restricted.

To provide insights on such changes, a discussion has been organized by Basavanagudi CPE Study Circle. The session covers:

  • Corporate guarantees , External commercial Borrowings and ESOPs
